This session will discuss family tensions that arise in the context of trusts and estates. This session aims to answer two critical questions. First, what techniques can be used in the estate planning process to avoid disputes? Secondly, what techniques can be used in the estate and trust administration process to avoid turmoil? Tangible personal property often has limited financial value; however, it has a vast emotional value. Why do so many simple estates become complex fights over the family furniture? Where did

grandma's wedding ring go? Through proper mediation techniques, some disputes can be handled without litigation. Family counseling and legal maneuvering often intersect in an estate dispute setting. This session will discuss proper drafting strategies that protect and indemnify fiduciary clients, such as trustees, executors, and conservators.
