The contractor shall provide the necessary paralegal claims support services required by the PWS. These contractor personnel shall have expertise in and experience within the insurance claims administration industry. FIMLD requires the contractor to deliver support within four Work Areas: 1) work related to complaint intake, processing, and tracking; 2) drafting legal memorandum, preparation of exhibits and trial books, witness preparation and coordination, potential courtroom appearances to support trial counsel in accordance with court-ordered deadlines; 3) consulting on issues related to the management and resolution of complaints; and 4) providing coordination on inspections, mediations, depositions, settlement conferences, etc. arising from complaints received.
Claims Intake, Processing, and Tracking:
The outside paralegal support shall become familiar with the NFIP through background research and training, for example, on the National Flood Insurance Act of 1968, as amended, NFIP regulations in Title 44 of the Code of Federal Regulations, the Standard Flood Insurance Policies, NFIP process and procedures, customary insurance practices, and the practices of other governmental entity cedents. 
The paralegal support shall include, but not be limited to, the receiving, processing, and tracking of all complaints, pleadings, correspondence and other materials received. The paralegal support shall include but not be limited to the collection and process claims files and underwriting files from FEMA’s Direct Servicing Agent (Torrent Technologies), appeals files from FEMA itself, from opposing counsel and third-parties, non-NFIP claim files where there is an allegation of multiple causes of loss, store claims files and other materials and legal pleadings in accordance with FEMA policy and procedures and in compliance with requirements that the SAUSA’s being supported have to comply with, updated case management systems, conduct data calls, develop and maintain status reports. 
The paralegal support shall include but not be limited to the analysis, review, redaction, Bates stamp, consolidation into Adobe PDF, and preparation of files for mandatory document exchanges with opposing counsel, witness interviews, summarizing depositions and witness statements, witness preparation and deposition coordination, subpoena preparation, preparing and propounding discovery requests, and responding to incoming discovery requests, as well as preparing witness exhibit binders, witness background checks, trial exhibits and trial binders, and other tasks necessary to the advancement and ultimate resolution of a case through settlement negotiations, appraisal or trial. The paralegal support shall include, but not be limited to, attending meetings and/or judicial hearings with DHS, FEMA, FIMA, USAO, and opposing counsel, for example, to create agendas, document meeting minutes and outcomes of meetings.
Drafting Legal Memorandum:
The paralegal support shall include, but not be limited to, researching and drafting memorandum on issues related to the claims and litigation process. Those documents may include, but are not limited to, settlement, filing of pleadings, researching case precedent and burden of proof issues, and other legal documents.
Consulting on Issues related to Management and Execution of Claims:
The paralegal support services shall provide subject matter expertise in effective and efficient litigation complaint handling. The paralegal support services shall consult on industry best practices in developing and streamlining litigation management and executing standard operating procedures and processes. This includes, but is not limited to, assisting in development of standard operating procedures, governance, reporting, documentation, exhibit preparation, evidence storage/retrieval, standardizing settlement agreements and certain pleadings/proposed orders, audits process documentation and other tasks necessary to the advancement and ultimate resolution of a case through settlement negotiations, appraisal or trial.
Advice on Potential Disputes:
The paralegal support contractor shall provide advice to FIMLD on potential disputes arising from NFIP complaints. Anticipated areas of work are researching standards for legal claims, burden of proof, witness background research, admissibility standards and preparation of documentation necessary to authenticate evidence, preparation of direct/cross/redirect questions for witnesses, researching and locating past favorable (or unfavorable) caselaw, and other tasks necessary to the advancement and ultimate resolution of a case through settlement negotiations, appraisal under the SFIP or trial.
