According to a recent combined study from MetLife Mature Market Institute (MMI), The National Committee for the Prevention of Elder Abuse (NCPEA), The Center for Gerontology at Virginia Polytechnic Institute and State University entitled, “Broken Trust: Elders, Family and Finances” reports that the annual financial loss by victims of elder financial abuse is estimated to be at least $2.6 billion dollars. It is vitally important for attorneys and legal assistants to be educated about fraud and financial ethics when it comes to family financial fraud to help deter or detect when fraud is occuring. Often times, it may only be the client’s attorney who can uncover and reveal financial abuse that can be occurring within a client’s trusted relationship.
This particular seminar will aim specifically at various types of family fraud. It will explain how to audit the family finances and set up some internal controls similar to a company. This is especially important if you have “non-family” members taking care of your elderly or your children. Unfortunately, most financial fraud is perpetrated by trusted violators such as family, close business associates, or neighbors. In these instances, the ethical responsibility to prevent, uncover, or correct the situation may lie solely with the attorney.

According to the Center for Disease Control’s National Center for Health Statistics, there are 68 divorces out of every 100 marriages in the U.S. Family Practice attorneys are hired to sort through divorce proceedings and settlements. It is vitally important for attorneys and legal assistants to be educated about fraud and financial ethics when it comes to divorcing couples.
This course provides a basic and advanced knowledge on marital fraud, the sources and uses of funds, situations where dissipation might occur, types of fraud evidence, examining for fraud, and the settlement effects with and without dissipation. Additionally, ethics are an underlying theme throughout the program as each divorce attorney’s responsibility to their client is to check for any possible fraud related activities before settlement. The course will explain how to discuss this sensitive area with clients. Fraud with direct evidence can often affect an entire settlement.
Many divorces deal with the financial after-effect of assets that are missing, hidden or dissipated. This seminar will explain how to discuss this sensitive area with clients and how important this information can be to settlement.
