Job Description:

Performs specialized legal research and writing in support of HCFSF work, including research and analysis of statutes, legislative intent, judicial precedents, agency rules and regulations, and law review articles as they relate to assigned cases to include those of an especially complex or unprecedented nature. Utilizes a variety of automated legal research tools as well as public information databases and other automated resources to research case- or program-specific legal matters, and to participate in assigned areas of criminal or civil proceedings, e.g. electronic discovery. Develops HCFSF case referrals by: ensuring that HCFSF referrals meet agency and United States Attorney's Office (USAO) standards for litigation; reviewing and evaluating referrals to determine the need for additional information and evidence, and planning a comprehensive approach to obtain this information and evidence. advising the HCFSF attorney(s) regarding the merits and weaknesses of HCFSF referrals based upon applicable law, evidence of liability and damages, and potential defenses, and recommends for or against commencement of judicial proceedings; helping the USAO develop new referrals, by ensuring a good working relationship with client agencies and the public, and by assisting in HCFSF training for federal, state and local agencies, preparing informational literature, etc. Performs a variety of tasks associated with litigation of health care fraud cases, including: receives and analyzes incoming pleadings and correspondence. Determines appropriate action and notes time limitations for responses; drafts correspondence and legal documents for HCFSF attorney's signature. Drafts proposed orders and decrees for signature of judges and magistrates; assists HCFSF attorneys in pretrial preparations by preparing, scheduling, reviewing, and organizing discovery; notifying, interviewing, and managing witnesses; and researching case law; supports HCFSF attorneys in court proceedings by briefing attorney on pertinent facts, issues, and case law, and by compiling, organizing, and indexing exhibits; Monitors the progress of pending cases and initiates action to insure the legal pleadings, forms, reports, correspondence, and other documents are prepared and submitted within established deadlines. Keeps appropriated staff members informed about the current status of cases; compiles, organizes and indexes various discovery and evidence exhibits for trial, witness testimony as it relates to specific criminal charge evidence, and develops and complies jury instructions to assist AUSA in preparing for trial; works closely with assigned attorney(s) to insure material is efficiently managed; prepares exhibits for trial which typically involves a wide range of visual materials including charts, diagrams, photographs and models. Depending on the nature and complexity of the case, personally prepares trial exhibits, or initiates preparation by other appropriate staff or contractors to ensure timely production prior to trial date; using one or more types of personal computer (PC) based software, i.e., word processing, spreadsheet, or database management, develops methods for automating reports, statistical data, text and graphics. Identifies end-used requirements, selects appropriate software, designs user-specific applications to include development of input software features. Established detailed functional procedures needed to enter and to retrieve data for other application users. Performs other related duties as assigned.

Education:

Paralegal certificate required. JD with litigation support experience preferred. An equivalent level of legal training may be substituted with approval. Requires sound working knowledge of legal system, legal research procedures, and sources of information.

Required Skills:

Required ability to locate, organize and index documents in support of depositions. Requires excellent written and oral communication skills, analytic ability, and thorough knowledge of legal research tools. Requires ability to write summaries of deposition testimony. Should have hands-on familiarity with a variety of computer applications including Microsoft Office software programs (i.e. Word, PowerPoint, Excel, and Outlook) and WordPerfect Office Suite. Ability to consistently deliver highest quality work under extreme pressure will be very important. At least two years of litigation paralegal experience required; trial experience very helpful. At least one year of litigation support preferred.

Must pass a credit and background check and pre-employment drug screen.
